Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ChaiSaab software, websites, and related services (collectively, the “Service”) offered by ChaiSaab (India) (“we”, “us”, “our”). By registering for or using the Service, you agree to these Terms.

1. Who we are

The Service is developed and operated by a small team. ChaiSaab (India) is an Indian company (One Person Company / private limited, as applicable). We maintain the product with professional care and iterate based on user feedback, but we do not warrant uninterrupted or error-free operation.

2. Nature of the Service

ChaiSaab provides digital tools for shops, customers, and marketplace participants (including inventory, orders, payments-related workflows, and related features). Some features may be experimental, in beta, or subject to change. You are responsible for validating results (including reports, calculations, tax-related displays, and integrations) against your own records and professional advice before relying on them for statutory, tax, or material business decisions.

3. Your account and security

You are responsible for safeguarding your credentials and devices. Where we offer multi-factor authentication (such as TOTP or similar), we strongly recommend enabling it. We are not liable for losses arising from compromise of your account due to weak passwords, credential sharing, phishing, failure to enable available security controls, or similar causes attributable to your environment.

4. Indemnity

To the fullest extent permitted by applicable law in India, you agree to indemnify, defend, and hold harmless ChaiSaab (India) and its directors, officers, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use or misuse of the Service; (b) your violation of these Terms or applicable law; (c) your interaction with third parties (including customers, suppliers, or payment providers) in connection with the Service; or (d) content or data you submit through the Service.

5. Limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data. Without limiting the foregoing, we shall not be responsible for financial losses resulting from account compromise where recommended security measures were not used, or from events outside our reasonable control (including natural disasters, war, terrorism, labour disputes, internet or cloud provider outages, or force majeure). Our aggregate liability for any claim relating to the Service shall not exceed the greater of (i) the fees paid by you to us for the Service in the twelve (12) months preceding the claim, or (ii) INR 5,000, except where liability cannot be limited under applicable law.

6. Data and backups

We employ industry-appropriate measures to protect data, but no system is immune to failure or attack. You should maintain independent records and backups of business-critical information. We do not guarantee recovery of data after catastrophic events.

7. Feedback

We welcome suggestions and will address feedback on a best-efforts basis. Feedback does not create an obligation to implement a feature or timeline.

8. Changes

We may modify these Terms or the Service. Material changes will be communicated where practicable (for example via the app or email). Continued use after changes constitutes acceptance where permitted by law.

9. Governing law and disputes

These Terms are governed by the laws of India. Subject to mandatory provisions, courts at Kochi, Kerala, India shall have exclusive jurisdiction over disputes arising from these Terms or the Service.
